AI and INTELLECTUAL PROPERTY POLICY

Effective Date: 12 May 2026

This AI & Intellectual Property Policy applies to all content created, published, delivered or displayed by Belle Verdiglione Photography, including but not limited to photographs, videos, branding, educational material, website content and digital media.

1. Ownership of Intellectual Property

All photographs, videos, graphics, branding, written material and creative works produced by Belle Verdiglione Photography remain the intellectual property of Belle Verdiglione Photography unless otherwise agreed in writing.

Copyright is protected under the Copyright Act 1968 (Cth).

Clients receive a non-exclusive licence to use purchased images for approved personal and business purposes only.

Copyright ownership is not transferred.

2. Prohibited Use of Images & Content

The following actions are strictly prohibited without prior written consent:
  • uploading images into AI platforms
  • training AI or machine learning systems using our content
  • generating derivative AI artwork from our images
  • likeness replication or avatar creation
  • screenshotting website or gallery images
  • applying filters that materially alter our work
  • editing photographs beyond cropping or adding text overlays
  • removing metadata, watermarks or identifying information
  • selling, sublicensing or redistributing images

This applies to all AI platforms including but not limited to:
  • Midjourney
  • DALL·E
  • Runway
  • Adobe Firefly
  • ChatGPT image tools
  • Canva AI tools
  • Stable Diffusion
  • future AI technologies not specifically listed

3. Client Usage Rights

Clients may:
  • crop images for social media or formatting purposes
  • add text overlays for marketing
  • use images for approved business and promotional purposes
Clients may not:
  • apply heavy filters or AI edits
  • manipulate skin tones, colours or photographic style
  • create altered versions that misrepresent the Photographer’s work
  • submit imagery into editing apps that fundamentally change the artistic integrity of the photographs

4. RAW Files & Unedited Content

RAW files, unedited images and original working files remain the sole property of Belle Verdiglione Photography and will not be supplied.
The Photographer retains full discretion regarding:
  • image selection
  • editing style
  • final delivery
  • archival and deletion timelines

5. Website & Social Media Content

All website and social media content created by Belle Verdiglione Photography is protected intellectual property.
No content may be:
  • copied
  • reposted without credit
  • repurposed
  • rewritten
  • reproduced for commercial gain
  • used to train AI systems
without prior written permission.

6. Breach of Policy

Unauthorised use of our intellectual property or breach of this policy may result in:
  • removal requests
  • revocation of usage licences
  • legal action
  • claims for damages under Australian copyright law

7. Australian Consumer Law

Nothing in this Policy excludes rights available under the Australian Consumer Law.
